These Terms & Conditions ("Terms") govern your use of the GoToCreatives Digital Marketing Services website and your engagement of our website design, development and marketing services. By using our website, submitting an inquiry, or purchasing a service, you agree to these Terms.
1. Who We Are
GoToCreatives is a website studio, founded by Jechris Olaya, that designs and builds conversion-focused websites, landing pages, sales pages, lead capture, email automation and upsell/cross-sell flows for coaches, speakers, authors, founders and small business owners.
2. Services
The specific scope, deliverables, timeline and price for any project are set out in a separate proposal or scope-of-work document agreed upon before work begins. These Terms apply in addition to — not instead of — that agreement; where the two conflict, the signed proposal controls.
3. Use of This Website
You agree to use this website only for lawful purposes and not to attempt to interfere with its normal operation, copy its content for commercial redistribution, or misrepresent your identity when submitting a form.
4. Intellectual Property
- Unless otherwise agreed in writing, the design system, code frameworks, and proprietary templates we use to build client websites remain the intellectual property of GoToCreatives.
- Content you provide to us (copy, images, brand assets, testimonials) remains your property, and you're responsible for having the rights to use it.
- Upon full payment for a completed project, you receive a license to use the final delivered website for your business, as described in your project proposal.
- The GoToCreatives name, logo, and this website's design are the property of GoToCreatives and may not be copied or reused without permission.
5. Payments & Refunds
Pricing and payment terms (deposits, milestones, due dates) are set out in your individual proposal. Projects generally begin once the initial deposit is received. Because our work involves real time and resources committed from the start of a project, deposits are generally non-refundable once work has begun, except where otherwise stated in your proposal. Late payments may pause project work until resolved.
6. Client Responsibilities
Timely delivery depends on you as well as us. You agree to provide requested content, feedback, and approvals within a reasonable time, and to ensure any materials you supply (copy, images, testimonials, brand assets) don't infringe on anyone else's rights.
7. Revisions & Scope Changes
Each project includes a defined number of revision rounds, described in your proposal. Requests beyond that scope, or changes to the original brief once work has started, may require an updated quote and timeline.
8. Warranties & Disclaimers
We build every site with care and to the specifications agreed in your proposal, but we can't guarantee specific business outcomes (traffic, leads, sales, conversion rates) since these depend on many factors outside our control, including your offer, market, and ad spend. Our website and services are provided "as is" without warranties of any kind beyond what's expressly stated in your project agreement.
9. Limitation of Liability
To the fullest extent permitted by law, GoToCreatives will not be liable for indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim related to a project is limited to the amount you paid us for that project.
10. Termination
Either party may end an ongoing engagement as described in the applicable proposal or agreement. Work completed and expenses incurred up to the termination date remain payable.
11. Governing Law
These Terms are governed by the laws of the Philippines, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website after changes take effect means you accept the updated Terms.
